The My Nintendo Princess Peach: Showtime! Trip to New York City Sweepstakes (“Sweepstakes”) is sponsored by Nintendo of America Inc., 4600 150th Ave NE, Redmond, WA 98052, USA (“Sponsor”).

Eligibility: Sweepstakes is open only to individuals who are legal residents of the 50 United States or the District of Columbia who are 18 years old or older at time of entry (“Entrant”). Directors, officers and employees of Sponsor and any of their respective parent and affiliate companies, subsidiaries, agents, professional advisors, and advertising and promotional agencies, and each of their immediate families and persons living in their same household, are not eligible to win any prizes.

Sweepstakes Period: The Sweepstakes begins on Wednesday, January 17, 2024 at 12:00 pm and ends Tuesday, February 20, 2024 at 11:59 pm (all times in these Official Rules are Pacific Time).

How to Enter: Limit three (3) entries per person. To enter, you must: (1) have a Nintendo Account (if you do not have a Nintendo Account you can register for one at https://my.nintendo.com/); (2) visit https://my.nintendo.com/rewards/571e0bb9a1348c2c;(3) sign in to your Nintendo Account; and (4) redeem 10 Platinum Points per entry at the My Nintendo Princess Peach: Showtime! Trip to New York City Sweepstakes page (https://my.nintendo.com/rewards/571e0bb9a1348c2c).

Selection of Winners: On or about February 22, 2024, a random draw will take place in Redmond, Washington to select one (1) potential winner from among all eligible Entries to award the Prize. The potential winner will be notified by email on or about February 23, 2024. To claim the prize, the potential winner must follow the instructions contained in the notification and respond within three (3) days.

Prize:

(a) There will be a total of one (1) Prize (“Prize”) awarded. The prize winner (“Winner”) will receive a four (4) day, three (3) night trip for Winner and up to two (2) Guests (“Guests”) to New York City, New York, between the dates of March 21, 2024 and March 25, 2024 (“Trip”).

Trip will include: round trip coach (economy) class air transportation for Winner and up to two (2) Guests from a major commercial airport near Winner’s home (as determined by Sponsor in its sole discretion) to New York City, New York; three (3) nights’ standard hotel accommodation (one room, quadruple occupancy, room and tax only) in Manhattan, NY at a hotel as determined by Sponsor in their sole discretion; non-exclusive ground transportation to and from airport and hotel in New York City, NY; $500 VISA gift card; $100 Nintendo New York store shopping credit; and a personal tour at the Nintendo New York store for Winner and up to two (2) Guests.

If winner is a resident of the New York tri-state area, air transportation may be substituted with another method of transportation by Sponsor in its sole discretion.

(b) Total ARV: $3,478.56 USD (actual value may vary depending on departure date and location).

(c) Prize Terms and Conditions: Trip must be completed between March 21, 2024 and March 25, 2024 or Trip portion of Prize will be forfeited. The airline(s), ground transportation (if applicable), airports, and hotel(s) will be chosen by Sponsor at Sponsor’s sole discretion. Trip packages, dates and times of travel, events and accommodations are subject to availability, and travel restrictions, conditions, and limitations may apply. Winner and his or her Guest(s) must travel together on the same trip itinerary, must travel on the dates specified by Sponsor, which are subject to change, and are solely responsible for having any required travel-related documents (including valid government-issued photo identification and/or any required passport or visa) prior to departure and fulfilling all other travel and security requirements; or prize will be forfeited in its entirety and may be awarded to an alternate winner, at Sponsor’s discretion, provided sufficient time remains to verify an alternate winner; otherwise, prize will not be awarded. Once the Guest(s) are determined, they cannot be changed without the express approval of Sponsor (which may be withheld for any reason). Sponsor will pay only the nightly rate and taxes for the hotel (all other incidental hotel expenses are the responsibility of the winner). Winner is responsible for all expenses, incidental travel costs, and all other costs not expressly provided in the prize description set forth above, including, but not limited to, ground transportation, meals, incidentals, passport costs, visa fees, and entry/exit fees, taxes, insurance, and other expenses. If Winner is between the ages of eighteen (18) and twenty-one (21), he/she must be accompanied by an adult of at least twenty-one (21) years of age in order to check into the hotel. Guest(s) must not be under eighteen (18) years of age (“Minor”), unless the Winner or the other Guest is the Minor’s parent or legal guardian. Sponsor will not be responsible if the Winner or Guest(s) misses any portion of the trip for any reason. No insurance is provided as part of the trip, and obtaining any insurance (such as travel insurance, health, accident or medical insurance, or property loss or damage insurance) is the sole responsibility of the winner and his or her Guest. The Winner is responsible for the conduct and behavior of his or her Guest(s). Sponsor will not replace any lost or stolen tickets, travel vouchers, or certificates. If attendance at or participation in an event is included in the prize: (a) no responsibility is assumed for any cancellation or rescheduling of any of the events included in the prize, in whole or in part; and (b) if any of the events included in the prize are postponed or cancelled for any reason, Winner may not receive the opportunity to attend those events as part of the prize, and the remaining elements of prize shall constitute full satisfaction of Sponsor’s prize obligation to winner and no substitute or additional compensation will be awarded.

(d) Odds of winning the prize depend on number of eligible entries received. Prizes not claimed within three (3)days after delivery of notification may be forfeited and awarded to an alternate winner. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Prizes may not be transferred to any other person. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). All federal, state, PROVINCIAL and local taxes associated with the receipt or use of any Prize are the sole responsibility of the winner.

Identity of Entrant: In the event of a dispute about the identity of the entrant, Sponsor may declare an entry to have been made by the authorized account holder of the e-mail address associated with the Nintendo Account used for the entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

Entrant’s Personal Information: Information collected from US residents is subject to Sponsor’s privacy policy at https://www.nintendo.com/privacy-policy. In addition, except where prohibited by law, entry into the Sweepstakes by any means constitutes permission. By participating in the Sweepstakes, you also acknowledge and agree that if you are the prize winner, as required by applicable law, your personal information may be shared with regulators, including, without limitation, your legal name, contact information, address, and prize description.

Additional Terms and Conditions: The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the State of Washington, USA. This Sweepstakes is subject to all applicable federal, state, provincial and local laws and is void where prohibited. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Sponsor shall not be responsible for late, lost, illegible, incomplete, damaged or misdirected entries and accept no responsibility for any injury, loss or damage of any kind resulting from an entrant’s participation in this Sweepstakes. Sponsor reserves the right to amend these Official Rules or to terminate this Sweepstakes.

Any delay or failure of Sponsor to perform its obligations under these Official Rules, including, without limitation, with respect to fulfillment of the prize or any part thereof, shall be excused to the extent that such delay or failure is caused by an event or occurrence beyond Sponsor’s reasonable control, including, without limitation, acts of God, actions by governmental authorities, fires, floods, storms, earthquakes, inclement weather, pandemic, natural disasters, riots, wars, terrorism, or labor disputes.

By entering the Sweepstakes, you release and hold harmless Sponsor, its partners, and their respective parent and affiliate companies, officers, directors, employees, representatives and agents from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or delivery, misdelivery, acceptance, possession, use of or inability to use the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Except where prohibited by law and subject to the applicable Nintendo privacy policy, entry into the Sweepstakes constitutes permission to use entrant’s name, city and state of residence, likeness and prize information, without limitation, for Sponsor's promotional purposes without further permission or compensation. Without limiting the foregoing, entrant understands and agrees that Sponsor may use (and may allow third parties to use) the entrant’s photo and/or video of the entrant on websites, Social Media pages, advertisements, and other promotional materials. Entrant’s grant of the foregoing permission is perpetual and may not be revoked by entrant. As a condition of being awarded a prize, winners will be required to confirm such permission in writing and execute and deliver a written affidavit of eligibility, acceptance of these Official Rules, a release of liability, a photo/video consent and publicity release, as well as tax forms and any other documentation required by Sponsor (collectively “Release Forms”). Guests will also be required to execute and deliver Release Forms. By entering, entrants certify that they have complied with these Official Rules and are eligible to win.
